Under the Family Law Act, the traditional terminology around custody and access has been changed. Parenting is now broken down into Guardianship, Parenting Time, and Contact. Guardianship involves the rights to make decisions respecting the child’s day-to-day care, including major decisions concerning the child’s overall upbringing and welfare. Parenting time is the time that the parent spends with their child.
Contact is exposure that a child has to a parent, relative, or other person who does not have Guardianship under the Act. Not all natural parents of a child will automatically be a guardian under the Act. If you are going through a separation or you have a child from a casual relationship, you should speak with an experienced family law lawyer to determine what your rights and responsibilities are respecting your child.
